4. Treasurer

A) Action to approve an Assembly Permit with waiver of the $300 license fee for Nevada Day, Inc., having a parade in downtown Carson City on October 28, 2006.

Staff Summary: Per CCMC 4.28.050 requires board approval for waiver of license fees.

B) Action to approve a packaged liquor license for Nevada CVS Pharmacy LLC dba CVS/Pharmacy #8779, with Juliet Burby as liquor manager, located at 220 Fairview Lane.

Staff Summary: Per CCMC 4.13 all liquor requests are to be brought before the liquor board.

C) Action to approve a packaged liquor license for Alanddon LLC, dba Arco Am/Pm #82392, with Mr. Allan Fiegehen and Mr. Donald Lehr as liquor managers, located at 720 South Carson Street.

D) Action to approve a packaged liquor license for Bdesh Inc, dba Eagle Gas I, with Mr. Mohammad Barkat, Mr. Zia Hassan, and Mr. Mohammad Ali as liquor managers, located at 2152 N. Carson St.

Board of Supervisors

5. Consent Agenda

All matters listed under the consent agenda are considered routine and may be acted upon by the Board of Supervisors with one action and without an extensive hearing. Any member of the Board or any citizen may request that an item be taken from the consent agenda, discussed and acted upon separately during this meeting.

5-1. Purchasing and Contracts

A) Action to renew Contract No. 0203-130 Junior Ski & Snowboard - Facility to Incline Village GID dba Diamond Peak Resort for the 2007 Junior Ski & Snowboard Program with the same terms & conditions as originally bid on June 11, 2003 and fees of $18 per chaperone, $18 per junior instructor, and $22 per participant.

Staff Summary: Bid #0203-130 contained the option to renew for four (4) additional one (1) year periods subject to negotiation and this will be for the third renewal period.

B) Action to approve Contract No. 0607-026 a request to purchase two (2) 2007 International Dump/Plow/Sander Trucks from Silver State International for a not to exceed cost of $246,370 from the FY 2006/2007 Street Maintenance Fund exempt from competitive bidding.

Staff Summary: On November 17, 2005 the Board of Supervisors awarded Contract No. 0506-065 to Silver State International to purchase between five (5) and nine (9) trucks for a cost of $116,685 per unit through February 28, 2006. A total of seven (7) trucks were purchased through February 28, 2006 using this bid.

5-2. Public Works - Engineering

A) Action to approve and authorize the Mayor to sign a Participation Agreement between Nevada West Lands, LLC, and Carson City for roadway engineering design and construction on Lepire Drive from Fairview Drive to approximately 290 feet eastward, in which Carson City agrees to reimburse Nevada West Lands, LLC an amount, as specified in the agreement, not to exceed a total of $64,609.00 from the Street Maintenance Overlays Account and other matters properly related thereto.

Staff Summary: The Board of Supervisors as part of the Sundance Ridge Phase II subdivision approval required the City to cooperate with the Developer on Lepire Drive Improvements. The applicant, Nevada West State Lands, LLC, agrees to perform certain work associated with roadway engineering design and construction, located on Lepire Drive from Fairview Drive to approximately 290 feet eastward, which work includes and is limited to the engineering design and construction of asphalt concrete pavement, curb, gutter and sidewalk, along with all appurtenances, including placement and compaction of base material and necessary grading. Carson City agrees to reimburse the applicant not to exceed seven thousand five hundred dollars ($7,500.00) for actual costs associated with engineering design of the above portion of Lepire Drive and not to exceed fifty seven thousand one hundred nine dollars ($57,109.00) which represents the actual construction costs of constructing the above improvements on Lepire Drive from Fairview Drive to approximately 290 feet eastward based on Contractor's estimate. This agreement will be binding on both parties for a 12-month period following the final date of the agreement or until the final completion of the project.

B) Action to approve Easement Agreements between State of Nevada Division of State Lands and Carson City whereby the Division of State Lands agrees to (1) grant a permanent easement upon, over and across certain real property described as Assessors's Parcels Number APN No. 10-041-55 (Nevada State Prison parcel along E Fifth St) for the purpose of construction, operation and maintenance of underground utility facilities and (2) grant temporary construction easements upon, over and across said real property for the purpose of construction of the utility facilities as part of the Carson City Freeway Phase 2A Utilities Relocation Project.

Staff Summary: The easements have been requested from State Lands to provide for the relocation of sewer and water facilities necessitated by conflicts between the existing utilities and the proposed construction of Phase 2A of the Carson City Freeway in the vicinity of E Fifth St & the Linear Park.

C) Action to approve Dedication of Land and convey all that certain real property located on APN 008-125-55, from the property owner, the Bernhard Family Trust, to Carson City, described as follows: ARW-1" which consists of 1,100.7 square feet and ARW-2" which consists of 2,263.1 square feet; as shown on the map titled ARecord of Survey #2 for the Bernhard Family Trust, and all that certain real property located on APN 008-125-56 described as follows: ARW-3" which consists of 9,662.3 square feet; ARW-4 which consists of 10,685.0 square feet; and ARW-5" which consists of 5,808.0 square feet as shown on the map titled ARecord of Survey #3 for the Bernhard Family Trust.

Staff Summary: This dedication is being offered by the property owner in coordination with the abandonment of a portion of Hot Springs Road, installation of drainage facilities, dedication of a portion of Market Street and Retail Drive.

5-3. Parks & Recreation - Open Space

Action to appoint and authorize the Mayor, the City Clerk Recorder or designee to swear Mr. Mark Warren as the appraiser for Carson City with regard to the self-contained appraisal of the following property on Carson City: 1) APN 7-031-04 and 7-091-26, consisting of 111 acres located at the terminus of Ash Canyon Road. 

Staff Summary: Appraisals are required by state law in order to determine the value of property to be purchased. This action is for appointment of Mr. Mark Warren as the appraiser for the property, as required by NRS. 244.275. This property is of interest to the Open Space program and is under Congress consideration for funding under the U.S. Forest Legacy Program. The approximate cost of the appraisal is $4,500.00 that will be paid from the Open Space Question 18 fund.

Ordinances, Resolutions, and Other Items

6. City Manager

Action to support an application to the Nevada Commission on Economic Development from Veltec Sports Inc. for economic incentives as a result of locating their business in Carson City.

Staff Summary: Veltec Sports Inc. is a distributor of parts and accessories for bicycling. They will create 32 new jobs paying an average wage of $23.20 an hour.

7. Public Works - Contracts

Action to accept Public Works Recommendation and award the "Governor's Field Drainage & Paving Improvements Project", Contract #2006-037 to (Bidder #1) Sierra Nevada Construction, Inc., for a Contract Amount of $696,007.00 and a Contingency Amount of $69,600.00 from the Capital Acquisition/Governor's Field Asphalt Repair Fund 220-0000-452-6512 as provided for in FY 2006/2007.

Staff Summary: Carson City received sealed bids for all labor, materials, tools and equipment necessary for the Governor's Field Drainage & Paving Improvement Project. This project in general consists of removal of existing curbs. gutter, and sidewalks, placement of new curbs, gutter and sidewalks, and pedestrian ramps, pulverize, regrading and paving of the parking lot and roadway surfaces; and signing, pavement legend, parking stall striping and includes all common phases of construction customarily associated with this type of project.

8. Public Works - Engineering

A) Action on a motion finding that a proposed ordinance adding Erosion and Sediment Control to the Carson City Municipal Code and Division 13, Erosion and Sediment Control, to the Development Standards, does not impose a direct and significant economic burden on a business nor directly restrict the formation, operation or expansion of a business, that a business impact statement has been prepared, accepted and is on file with the Board of Supervisors and that the requirements of the Chapter 237 of the Nevada Revised Statutes have been met by staff's action.

Staff Summary: A proposed ordinance adding a new section to Chapter 12 of the Carson City Municipal Code regarding erosion and sediment control and Division 13, regarding erosion and sediment control, has been presented to the Builders Association of Western Nevada (BAWN), engineers, developers and property owners. Of those interested parties, comments and questions over a year period were generally seeking clarifications on requirements and discussing common and unique drainage situations.

B) Action to introduce on first reading, an ordinance amending Carson City Municipal Code Title 18 Zoning, Chapter 18.16 Development Standards, by adding Division 13, Erosion and Sediment Control, which contains Section 13.1 Introduction; Section 13.2 Minimum Requirements for Erosion & Sediment Control; Section 13.3 Construction SWPPP; Section 13.4 Checklists for Construction SWPPPs; Section 13.5 Best Management Practices; Appendix 1 Recommended Standard Notes for Erosion Control Plans and References.

Staff Summary: This new Division to the Carson City Development Standards fulfills the State and Federal requirements under the City's Storm Water (NPDES) Phase II Permit. Division 13, Erosion and Sediment Control, adds sections for developing, implementing and guidance in reducing pollutants generated from construction activities from entering the City's municipal storm water conveyance system. Specifically, the new division provides for program's goals and objectives; states factors that influence the erosion potential of a site; lists minimum requirements for erosion & sediment control; outlines and describes recommended step-by-step procedures for developing a construction Storm Water Pollution Prevent Plan (SWPPP); includes a checklist that can be used as a quick reference to determine if all the major items are included in the construction SWPPP; groups Best Management Practices (BMPs) according to three main categories to provide general guidance for selection and implementing BMPs that will eliminate or reduce the discharge of pollutants from construction sites. An appendix is included recommending standard notes for erosion control plans and a list of references. This new division has been reviewed and presented to the public, engineers and contractor's over the past year. In July 2005, notices were published requesting comments on the new division. Documents were available at City Hall, the library and the permit center as well as through the city's web site by emailed link. Workshops were held in November 2005 and again in May of 2006 to review the requirements and take input. In July 2006, a brochure addressing maintenance of private storm drain system was mailed to all property owners within the city.

C) Action to introduce on first reading, an ordinance amending the Carson City Municipal Code Title 12, Water, Sewerage, and Drainage by adding a new section titled Chapter 12.18 Erosion & Sediment Control. This new section contains Chapters 12.18.010 Definitions; 12.18.020 Applicability; 12.18.030 Exceptions to Applicability; 12.18.040 Permits and Fees; 12.18.050 Failure to Complete the Work; 12.18.060 Denial of Permit; 12.18.070 Responsibility of Permittee; 12.18.080 General Requirements; 12.18.090 Inspection of Sites Under Permits; 12.18.100 Maintenance Requirements; 12.18.110 Notification of Needed Maintenance; 12.18.120 Acts Resulting in Violation of Federal Clean Water Act; 12.18.130 Enforcement and 12.18.130 Request for Hearing.

Staff Summary: This new section to the Carson City Municipal Code fulfills the State and Federal requirements under the City's Storm Water (NPDES) Phase II Permit. 9. Public Works - Planning and Zoning

A) Action to adopt Bill No. 121, on second reading an ordinance amending Carson City Municipal Code Title 18 Zoning, Chapter 18.03 Definitions, Section 18.03.010 Words and Terms Defined to add the definition of automobile dealerships, new, Amending Title 18 Zoning, Chapter 18.16 Development Standards, Section 18.16.005 Development Standards, Division 4 Signs, Section 4.6 General Regulations and Standards, 4.6.3 Number of Freestanding Signs by adding Section C to specify the number of freestanding signs allowed for automobile dealerships use and by adding a new section 4.7.8 New Automobile Dealership Uses, and other matters properly related thereto. File ZCA 06-100

Staff Summary: This code amendment will modify the City's existing sign code by adding a section for new automobile dealerships and their signage needs. The code addresses an overall signage maximum, building's signs, freestanding signs, number, height and size, secondary signs and other permitted uses such as pennants, large inflatable devices, balloons, banners and changeable and directional signs; as well as administrative variances.

B) Action to approve a Final Subdivision Map known as Sundance Ridge Phase II from Peak Consulting Engineers, LLC (property owner: Nevada West Land, LLC) resulting in 32 residential lots, on property zoned General Commercial (GC), located at 4024 and 4012 Lepire Drive and 823 North Edmonds Drive, APNs 010-351-92, -93 and -04, which fully complies with all of the conditions of approval as contained in the tentative map staff report, pursuant to the requirements of the Carson City Municipal Code. Staff Summary: The BOS granted approval of the Tentative Subdivision on November 17, 2005, a Final Subdivision Map must be approved by the Board of Supervisors prior to dividing the property.

Redevelopment Authority

10. Redevelopment

Presentation and discussion to begin development of the Redevelopment Authority's goals and expectations related to a comprehensive approach to a development incentive program. A flexible incentive program features a public/private partnership model with techniques that overcome impediments to development and enhance cash flows. The purpose of the program is to spur, attract and maintain high quality growth and promote investment in Redevelopment Project Area No. 2.

Staff Summary: A public/private partnership is a creative alliance between the governmental entity and the private sector to achieve a common purpose through a transparent public process. The Redevelopment Authority must validate a project's public purpose before it can even consider public participation. Once a project is validated, the Authority may choose to incentivize a project through a negotiation process with essential safeguard's to ensure the project's financial viability. At this meeting, the Redevelopment Authority is being asked to initiate a broad-based discussion of rewards and risks, benefits and costs, and financial and legal hazard as we define and consider the steps to take to create a flexible set of rules to follow in structuring how we create a redevelopment incentive program.
