Public Comments and Discussion: The public is invited at this time to comment on and discuss any item not on the agenda that is relevant to, or within the authority of, the Carson City Board of Supervisors, the Carson City Liquor and Entertainment Board and the Carson City Redevelopment Authority. No action may be taken on a matter raised under this item of the agenda until the matter itself has been specifically included on an agenda as an item upon which action will be taken. Public comment during individual agenda items will be taken on the item at the time the item is called for hearing.

3-1. Purchasing and Contracts

A) Action to approve Amendment No. 2 for Contract No. 0506-035 Carson City Community Transit Service Operations to MV Transportation, Inc. which will result in $86,584.60 in savings during the period of October 1, 2006 through September 30, 2007 and in $88,999.64 in savings during the period of October 1, 2007 through September 30, 2008 to the Carson City Transit Fund.

Staff Summary: Amendment No. 2 will allow MV Transportation, Inc. to fuel all vehicles used in the performance of this Contract using City provided fuel cards.

B) Action to approve Contract No. 0607-036 a request for professional services to be provided by MacWest Marketing to provide professional level marketing services to the City's fixed-route transit system - Jump Around Carson (JAC) through October 4, 2007 for a not to exceed cost of $77,000 from the Transit Fund.

Staff Summary: On August 23, 2006, the Carson City Regional Transportation Commission (RTC) recommended that Carson City enter into a contract for these services. MacWest Marketing has extensive marketing expertise and extensive experience in the Carson City area.

C) Action to approve Contract No. 0607-042 a request to have the Board of Supervisors determine that the listed City property is no longer required for public use and deem its sale by public auction desirable and in the best interest of Carson City.

Staff Summary: Staff has requested the following vehicles and/or equipment to be declared surplus and authorize their disposal by public auction to be conducted by TNT Auctions on October 21, 2006.

3-2. Public Works - Contracts

Action to accept the recommendation of Public Works to accept the work as completed, to accept the Contract Summary as presented, and approve this Release of Final Payment in the amount of $91,980.77, on the Saliman Road to Mills Park Reclaimed Water Main Extension Project, Contract #2005-001, to RaPiD Construction, Inc.

Staff Summary: Carson City accepted sealed bids for all labor, materials, tools and equipment necessary for the installation of approximately 5500 linear feet of reclaimed water pipe and appurtenances in Saliman Road between Mills Park and East Fifth Street in Carson City. The majority of materials were furnished by Carson City. The project included all common phases of construction customarily associated with this type of project.

3-3. Public Works - Engineering

A) Action to approve and authorize the Mayor to sign Release and Cancellation of an Ordinance No. 1991-58 and a Development Agreement between Snap-on Tools and City of Carson City regarding Assessor's Parcel Number 10-051-37, previously APN 10-051-12 and 10-051-13, located at 1880 Fairview Drive, Carson City, Nevada.

Staff Summary: The applicant, Snap-on-Incorporated, and the City agree to rescind and cancel the Development Agreement (Ordinance No. 1991-58). Snap-on-Incorporated entered into new Agreement with Carson City for right-of-way, easements and permission to construct for the widening of Fairview Drive, as recommended by the Regional Transportation Commission which satisfies the requirements contained in the Development Agreement.

B) Action to approve and authorize the Mayor to sign the Release and Cancellation of the Improvement Agreements between Carson City and:
- Stanton Park Development, Inc., for the construction of public improvements related to development of Mountain Park Subdivision, Unit No. 11,
- Northridge LLC for the construction of public improvements related to development of Northridge Subdivision, Phase 11,
- Northridge LLC for the construction of public improvements related to development of Northridge Subdivision, Phase 8,
- Alexander K. Bernhard and Lenore J. Bernhard, Co-Trustees of the Bernhard Family Trust for the construction of public improvements related to Hidden Meadow Estates, Unit 4.

Staff Summary: Staff is requesting that the Board of Supervisors rescind and cancel the Improvement Agreements between Carson City and the properties described above as the improvements have been completed and have passed the warranty period as acceptable.

Action to approve a request from Jennifer Verive & Gary Cain property owner, for a Carson City Historical Tax Deferment on property located at 412 North Curry Street, APN 003-225-10. (File HRC-06-160)

Staff Summary: The subject property is eligible for the Open Space Use Assessment as a result of its conformance to specific standards and its historical status in Carson City.

3-5. Parks and Recreation - Open Space

Action to accept the recommendation of the Open Space Advisory Committee to authorize the Open Space Manager to enter into a contract with Wood Rodgers, Inc., for Phase III of the Open Space Wetland Rehabilitation Project for a not-to-exceed sum of $92,620. The wetland is located north of Northridge Drive, south of College Parkway, East of Lompa Lane, and west of the Northridge/Mountain Park Subdivisions.

Staff Summary: The contract will allow for Tasks #2 through #5 to be completed by Wood Rodgers, Inc., to design for the use of effluent and/or charges into the hydrology to improve the existing wetlands, which is owned by Carson City, and the nature area which is to be deeded to Carson City by the Northridge Development. In addition, other tasks call for the design of trails and signage for the public enjoyment of the wetland areas.

Ordinances, Resolutions, and Other Items

4. Justice Court

Action to approve setting the minimum compensation for the Justices of the Peace of the City of Carson City at $68,151.65.

Staff Summary: NRS 4.040 requires that, at a regular meeting of the Board of Supervisors in July of any year in which an election of justices of the peace is held, they shall set the minimum compensation of the justices of the peace for the ensuing term.

5. Human Resources

Action to institute a pre-employment drug screening procedure for all candidates seeking employment effective November 1, 2006 that will test for Amphetamines, Marijuana, Cocaine, Opiates (heroin, morphine, oxycodone and vicodin), and PCP.

Staff Summary: In order to ensure a productive workforce, a safe workplace, and a drug-free work environment, Human Resources will begin a pre-employment drug screening program. Any offer of employment will be contingent on successful completion of pre-employment drug screening. This program will provide a savings to the City in costs associated with absenteeism, liability issues, disciplinary problems, and increased productivity. The Board of Supervisors has made the elimination of methamphetamines one of its top priorities and the implementation of pre-employment drug screening program for City employees is a logical and natural extension of this priority.

6. Internal Auditor

A) Presentation of internal audit report regarding health insurance premiums.

B) Action to approve a reimbursement agreement between the City of Carson City and Saint Mary's HealthFirst for overpaid insurance premiums for the period July 2003 through June 2006.

Staff Summary: Per request from the City's Director of Finance and Director of Human Resources, the Internal Auditor was asked to examine the monthly Saint Mary's HealthFirst invoices beginning with July 2003. The purpose of this review was to determine if the City of Carson City was being billed properly for policyholders based on their coverage classification, coverage type and status with the City. The audit revealed overpayments to Saint Mary's HealthFirst and a reimbursement due to Carson City in the amount of $152,588.19.

7. Public Works - Planning and Zoning

A) Action to adopt, on second reading, Bill No.124, an ordinance affecting a Zoning Map Amendment to change the zoning from Single Family 12,000 (SF-12) and General Industrial (GI) to General Commercial (GC), on property at 4820 East Nye Lane APN 008-382-14 (SF-12) and 4880 East Nye Lane APN 008-382-36 (GI). (File No. ZMA-06-144)

Staff Summary: Approval of the Zoning Map Amendment would change the designation of the subject parcels on the official Carson City Zoning Map from Single Family 12,000 (SF-12) and General Industrial (GI) to General Commercial (GC).

B) Action to adopt on second reading, Bill No.125, an ordinance affecting a Zoning Map Amendment to change the zoning of the eastern half of property located at 7051, 7101, 7171 and 7207 Center Drive, APNs 009-311-29, -30, -31 and -46, a total of approximately 4.7 acres, from Single Family One Acre (SF1A) to Single Family 6,000 (SF6). (File No. ZMA-06-137)

Staff Summary: Approval of the Zoning Map Amendment would change the designation of the subject parcels on the official Carson City Zoning Map from Single Family One Acre (SF1A) to Single Family 6,000 (SF6).

C) Action to adopt, on second reading, Bill No.126, an ordinance amending Carson City Municipal Code Title 18 Zoning, Division 2 Parking and Loading, Section 2.2(A) Residential Parking Requirements by deleting parking requirements specific to planned unit developments and adding a requirement to provide guest parking spaces when public street widths are reduced to preclude on-street parking, and other matters properly related thereto. Staff Summary: This code amendment would make the parking standards for Planned Unit Developments with other residential parking requirements and provides for additional off-street parking requirements, where appropriate.

D) Action to adopt, on second reading, Bill No.127, an ordinance affecting a Zoning Map Amendment to change the zoning of a portion (0.246 acres) of APN 008-754-19, located at 653 Shenandoah Drive, from Single Family One Acre (SF1A) to Public Community (PC), and to change the zoning of a portion (0.053 acres) of APN 008-754-21, located to the northeast of APN 008-754-19, from Public Community (PC) to Single Family One Acre (SF1A). (File No. ZMA-06-125)

Staff Summary: The proposed amendment will align the boundaries of the Zoning Map with the proposed property boundaries between the residential parcel and the City's drainage facilities parcel resulting from an adjustment of the property boundary.

E) Action to adopt, on second reading, Bill No.128, an ordinance affecting a Zoning Map Amendment to change the zoning from Mobile Home 12,000 (MH12) to Mobile Home 6,000 Planned Unit Development (MH6-P) on 5.4 acres located at 3860 East Nye Lane, Assessor's Parcel Number 008-192-69. (File ZMA-06-142)

Staff Summary: Approval of the Zoning Map Amendment would change the zoning on the official Carson City Zoning Map of the subject parcel from Mobile Home 12,000 (MH12) to Mobile Home 6,000 Planned Unit Development (MH6-P). This zoning reclassification would implement stated City objectives.

F) Action to adopt, on second reading, Bill No.129, an ordinance affecting a Zoning Map Amendment to change the zoning from Single Family One Acre (SF1A)/Retail Commercial (RC) to Multi Family Apartment-Planned Unit Development (MFA-PUD), on property north of Overland Street and south of Roventini Way, APNs 009-263-02, 009-263-03, 009-263-04 and 009-263-05. (File ZMA-06-145)

Staff Summary: Approval of the Zoning Map Amendment would change the designation of the subject portion of the parcel on the official Carson City Zoning Map from Single Family One Acre (SF1A)/Retail Commercial (RC) to Multi Family Apartment-Planned Unit Development (MFA-PUD). This Zoning Map Amendment is directly associated with TPUD-06-146 Clear View Ridge.

8. Public Works - Contracts
Action to accept Public Works recommendation and award the Health Services Building 1st Floor Remodel Project, Contract # 2006-038 from the Fiscal Year 2006/2007 Construction Projects/Health Services Building Account 330-0000-441-7821 for the following Work Scope Numbers 1, 2, 3, 4, 5, 6, 7, 8 and 10 as provided in the bid tabulation, for a Contract Amount of $281,974.00 and a contingency amount of $28,000.00.

Staff Summary: Carson City Public Works previously received sealed bids for all labor, material, tools and equipment necessary for Trade Contractors associated with the Health Services Building 1st Floor Remodel Project located at 900 East Long Street, Carson City, Nevada 89706.

9. Public Works - Operations

A)Update on the Arsenic Reduction Program.

Staff Summary: This new Division to the Carson City Development Standards fulfills the State and Federal requirements under the City's Storm Water (NPDES) Phase II Permit. Division 13, Erosion and Sediment Control, adds sections for developing, implementing and guidance in reducing pollutants generated from construction activities from entering the City's municipal storm water conveyance system. Specifically, the new division provides for program's goals and objectives; states factors that influence the erosion potential of a site; lists minimum requirements for erosion & sediment control; outlines and describes recommended step-by-step procedures for developing a construction Storm Water Pollution Prevent Plan (SWPPP); includes a checklist that can be used as a quick reference to determine if all the major items are included in the construction SWPPP; groups Best Management Practices (BMPs) according to three main categories to provide general guidance for selection and implementing BMPs that will eliminate or reduce the discharge of pollutants from construction sites. An appendix is included recommending standard notes for erosion control plans and a list of references. This new division has been reviewed and presented to the public, engineers and contractor's over the past year. In July 2005, notices were published requesting comments on the new division. Documents were available at City Hall, the library and the permit center as well as through the city's web site by emailed link. Workshops were held in November 2005 and again in May of 2006 to review the requirements and take input. In July 2006, a brochure addressing maintenance of private storm drain system was mailed to all property owners within the city.

B) Action to adopt, on second reading, Bill No.123, an ordinance amending the Carson City Municipal Code Title 12, Water, Sewerage, and Drainage by adding a new section titled Chapter 12.18 Erosion & Sediment Control. This new section contains Chapters 12.18.010 Definitions; 12.18.020 Applicability; 12.18.030 Exceptions to Applicability; 12.18.040 Permits and Fees; 12.18.050 Failure to Complete the Work; 12.18.060 Denial of Permit; 12.18.070 Responsibility of Permittee; 12.18.080 General Requirements; 12.18.090 Inspection of Sites Under Permits; 12.18.100 Maintenance Requirements; 12.18.110 Notification of Needed Maintenance ; 12.18.120 Acts Resulting in Violation of Federal Clean Water Act; 12.18.130 Enforcement and 12.18.130 Request for Hearing.

Staff Summary: This new section to the Carson City Municipal Code fulfills the State and Federal requirements under the City's Storm Water (NPDES) Phase II Permit. This Code amendment will address the application and enforcement of erosion and sediment control during construction and for continued maintenance on all property. The new chapter adds definitions of terms; states that any person who undertakes any earth disturbance is subject to this ordinance; lists the conditions where there may be exceptions; states there are no new fees or permits to apply this ordinance; states the action the City will take when the condition of a city permit is not fulfilled; states the conditions when a city permit will not be issued; states the responsibility not to cause damage or put other property in danger; lists the requirements of engaging in earth disturbance for temporary and permanent erosion control facilities; states the action the city engineer will take to enforce the ordinance; states the responsibility to maintain permanent sediment and erosion control facilities after construction; states the procedure of notification; states that violators are subject to civil and criminal penalties; gives the city engineer the ability to enforce this ordinance; gives the process to request a hearing and other matters properly related thereto. This new section has been reviewed and presented to the public, engineers and contractor's over the past year. In July 2005, notices were published requesting comments on the new division. Staff Summary: Carson City Health and Human Services has implemented several key programs to ensure the needs of Carson City residents are met. We would like to update the Board of Health of these programs along with key issues that we may be facing in the future.

12. Redevelopment

A video presentation of the future look of Downtown Carson City.

Staff Summary: In September 2005, over a thousand Carson City residents participated in a two-day professionally directed "design studio" to provide a consensus for the future look of Carson City's Downtown. As a result, the Envision Carson City team commissioned this 3-D virtual tour that provides a birds-eye view of the future look of downtown Carson City: a walkable destination where residents and visitors alike will shop, dine and indulge in a myriad of cultural activities. Our goal is to create a scale and a street presence that will retain and further enliven the authentic character of Carson City. The quality of the streetscape and the public realm is essential to attract new residents and new businesses. Because Downtown is both Carson City's and the State of Nevada's front door, someday folks who now work here but live elsewhere and those frequent patrons from our outskirts or other communities will dream of opening a business here or even living in Downtown Carson City.
