Public Comments and Discussion: The public is invited at this time to comment on and discuss any item not on the agenda that is relevant to, or within the authority of, the Carson City Board of Supervisors, the Carson City Liquor and Entertainment Board and the Carson City Redevelopment Authority. No action may be taken on a matter raised under this item of the agenda until the matter itself has been specifically included on an agenda as an item upon which action will be taken. Public comment during individual agenda items will be taken on the item at the time the item is called for hearing.

4. Consent Agenda
All matters listed under the consent agenda are considered routine and may be acted upon by the Board of Supervisors with one action and without an extensive hearing. Any member of the Board or any citizen may request that an item be taken from the consent agenda, discussed and acted upon separately during this meeting. The Mayor, or the Mayor Pro-Tem, retains discretion in deciding whether or not an item will be pulled off the consent agenda.
4-1. Sheriff
Staff Summary: The Nevada State Juvenile Justice Programs Office awards grant funds to state and local units of government for a wide variety of programs which are designed to reduce alcohol use among juveniles.
4-2. Development Services - Engineering
Staff Summary: Development Engineering staff is requesting that the Board of Supervisors approve this Waterline and Sewerline Reimbursement Agreement between Carson City and South Carson, LLC.
4-3. Purchasing and Contracts
Staff Summary: Pursuant to NRS 338.1444(4) - at least once a quarter, a local government shall prepare a report detailing for each public work awarded pursuant to NRS 338.1444(1) (a): (1) the name of the contractor to whom the contract was awarded; (2) the amount of the contract awarded; (3) a brief description of the public work; and (4) the names of all contractors from whom bids were solicited. A report prepared pursuant to this section is a public record and must be maintained on file at the administrative offices of the applicable public body. The provisions of this section do not relieve a local government from the duty to award the contract for the public work to a bidder who is the lowest responsive and responsible bidder if bids are required to be solicited from more than one properly licensed contractor.
4-4. City Manager
Action to appoint Paul Pugsley to the Carson River Advisory Committee, term to expire July 2011.
Staff Summary: Resolution number 2000-R-20 re-establishes the Carson River Advisory Committee to consist of seven members appointed by the Board of Supervisors and that one member to represent "Recreational Issues" who is a resident of Carson City. There is one vacancy for a three year term due to an existing member's term expiring. There is one applicant.
4-5. Finance
Staff Summary: Pursuant to NRS 361.460, the Board of Supervisors is required to set the Carson City Tax Rate once per year after the Nevada Tax Commission certifies the tax rates. This resolution sets the tax rate as approved in the Board of Supervisors and Redevelopment Authority budget hearings as well as setting the local rate for other governing bodies.
4-6. Treasurer
Staff Summary: According to the Carson City Charter, Sec. 3.045 2(d), the Treasurer shall establish and maintain a policy for the investment of the surplus money of Carson City. The Board of Supervisors shall review the policy at least once a year at a public hearing at which public comment is accepted.
B) Presentation of repurchase agreement counter parties for approval.
Staff Summary: According to the Carson City Investment Policy and NRS 355.170 2(a), in order for Carson City to invest in repurchase agreements, any counter parties must be approved by the governing body. Attached is a list of counter parties for your approval. This list is a subset of the list approved by Clark County this last January.

Ordinances, Resolutions, and Other Items
5. City Manager
A) Presentation and update by Nevada Rural Housing Authority regarding the 2008 Private Activity Bond Cap allocation, their new programs and future plans.
Staff Summary: Executive Director Gary Longaker will provide the Board with an update including the success of the program in Carson City.
Staff Summary: Pursuant to NAC 348A.180, Carson City may annually transfer a share of State money set aside for tax exempt loans for industrial development and affordable housing projects, referred to by the State as "private activity bond volume cap." Carson City may allocate its share to specific projects that apply and qualify with the State, or the allocation goes back into the general State-wide pool.
6. Public Works
Staff Summary: The proposed ordinance revision establishes new criteria and exemptions for new and existing food related businesses regarding the installation of grease interceptors.
Staff Summary: These water applications propose to use water from induction wells in Carson City, pursuant to the agreements with Vidler Water Company and Lyon County, to serve users within the service area of Carson City Water Utility, as well as the Dayton Valley portion of the service area of Lyon County Utilities.
7. Development Services
Status report regarding the Racetrack Nuisance.
Staff Summary: Staff will provide the Board with a status report regarding the racetrack nuisance as to whether the property owner/developer will undertake the cleanup and mitigation of the nuisance aspects of the site or if Carson City will undertake the task.
8. Development Services - Planning
Staff Summary: In order to create consistency with the Carson City Building Code as well as other northern Nevada counties, staff is proposing a change to the Carson City Municipal Code to allow up to and including six children to be allowed in home child care without obtaining a Special Use Permit. Currently, the code allows up to and including five children.
Staff Summary: Tentative Map approvals remain valid for one year for recording of a subsequent final map once an initial final map is recorded. A one year extension may be granted by the Board of Supervisors for filing of a final map. If this extension is approved the new expiration date for the Tentative Map approval will be August 21, 2009.
9. Parks and Recreation
Action to approve the recommendation of the Open Space Advisory Committee to authorize Mayor Teixeira to sign an offer and purchase contract for the fee title purchase of the Wilson Trust properties, APNs 7-091-26 and 7-031-04, containing approximately 111 acres located on Ash Canyon Road at the ridge of the Carson Range, and to accept a reimbursable Legacy Grant for approximately $450,000.00 towards this acquisition. Staff Summary: Pending the approval of the Board of Supervisors, the Wilson Trust has accepted an offer to sell to Carson City for open space purposes approximately 111.21 acres located at the top of Ash Canyon Road. The purchase price of $585,000 will be paid out of the Open Space acquisition account. Through the U.S. Forest Service Forest Legacy Program, Carson City will be reimbursed 75% of those expenses up to $500,000. The property possesses attributes which are important to Carson City including providing motorized access to the Lake Tahoe State Park Hobart Reservoir trailhead, scenic protection, preservation of forested habitat lands, preservation of watershed, and it is located within the Carson Range Open Space Priority Area as designated by the Open Space Master Plan.
10. District Attorney
Staff Summary: The Federal Bureau of Investigation (FBI) has informed Carson City that, after August 29, 2008, the FBI will no longer accept fingerprint cards submitted for national, criminal-background checks for business license applicants unless there is an underlying local ordinance authorizing the practice. Nevada Revised Statute (NRS) 239B.010 (1) (a) authorizes political subdivisions of the state to request of and receive from the FBI information on the background and personal history of persons seeking licenses. However, the FBI requires a more specific authorization that allows the fingerprint-background-check practice at the ordinance level. In particular, the FBI requires that such an ordinance express: (1) the specific business, profession, or occupation to which an application for a license applies, for which applicants must be fingerprinted; (2) specific authorization for the submission of the fingerprints for a national, criminal-background check; and (3) a reference to the authorizing state statute, NRS 239B.010 (1) (a). The proposed ordinance fulfills the requirements set forth by the FBI, so that Carson City may continue to submit fingerprint cards to the FBI for a national, criminal-background check of certain business-license applicants. In particular, the business license applicants affected by the ordinance are: (1) applicants seeking an alcoholic beverage license; (2) applicants seeking a pawnbroker's license, pawnshop license, second-hand dealer's license, or an antique dealer's license; and (3) applicants seeking a solicitor's license.
