The public is invited at this time to comment on and discuss any item not on the agenda that is relevant to, or within the authority of, the Carson City Board of Supervisors, the Carson City Liquor and Entertainment Board, the Carson City Redevelopment Authority and the Carson City Board of Health. No action may be taken on a matter raised under this item of the agenda until the matter itself has been specifically included on an agenda as an item upon which action will be taken. Public comment during individual agenda items will be taken on the item at the time the item is called for hearing.

9. Consent Agenda

All matters listed under the consent agenda are considered routine and may be acted upon by the Board of Supervisors with one action and without an extensive hearing. Any member of the Board or any citizen may request that an item be taken from the consent agenda, discussed and acted upon separately during this meeting. The Mayor, or the Mayor Pro-Tem, retains discretion in deciding whether or not an item will be pulled off the consent agenda.

9-1. Sheriff

A) Action to approve the acceptance of the FY10 Enforcing Underage Drinking Laws grant in the amount of $25,000.00. (Kenny Furlong)

Staff Summary: The Office of Juvenile Justice and Delinquency Prevention awards grant funds to state and local units of government, and non-profit agencies for a wide variety of programs which are designed to reduce alcohol use among juveniles.

B) Action to adopt a resolution adopting and approving an Interlocal Contract between Lyon County, Nevada, a political subdivision of the State of Nevada, and Carson City, Nevada, a consolidated municipality and political subdivision of the State of Nevada, to mutually share law enforcement personnel on an as-needed basis and other matters properly related thereto. (Kenny Furlong)

Staff Summary: Adoption of this agreement will allow Lyon County and Carson City to share law enforcement personnel upon request by either agency. Neither Lyon County nor Carson City are required to agree to a request to provide personnel, if the request will deplete or diminish law enforcement service levels needed by Lyon County or Carson City, or if the request will endanger the residents of Lyon County or Carson City.

9-2. Assessor

Annual report of the Carson City Assessor per NRS 250.085. (Dave Dawley)

Staff Summary: The Nevada Legislature created a fund in the 2003 legislative session for the acquisition and improvement of technology in the office of the county assessor (NRS 250.085). This fund is similar to the Recorder's fund already established. It may be used to enhance technology within the Assessor's Office or at the Assessor's discretion, may be shared with other departments to help enhance their ability to share information between the departments.

9-3. Public Works

A) Action to adopt a resolution approving an interlocal agreement by and between Carson City and Douglas County relating to the exchange of water rights and finding that the sale of the water rights to Douglas County in exchange for other water rights will be in the best interests of Carson City. (Andy Burnham)

Staff Summary: Adoption of the Resolution approving this agreement will resolve the protest regarding transfer of Lompa water rights to Douglas County.

B) Action to adopt a resolution approving the cooperative agreement between State of Nevada Department of Corrections and Carson City for water service to the Northern Nevada Correctional Center. (Ken Arnold)

Staff Summary: Adoption of the Resolution approving this agreement will continue to allow Carson City to provide water service to the Northern Nevada Correctional Center, facilitate the location of a new City well on State property, and will maintain the State of Nevada Department of Correction's water rights in good standing with the State Engineer.

9-4. Fire

Action to authorize staff to pursue a grant through (ARRA) American Recovery and Reinvestment Act-Assistance to Firefighters Fire Station Construction Grant, in the amount of $993,106.18 for upgrades and addition to Fire Station #2. (Tom Tarulli)

Staff Summary: The $210 million (ARRA) grant is new for the Fire Service, and is designed to enhance our capabilities and improve response to hazards. If authorized to proceed with the grant application and staff is successful in obtaining the grant, upgrades and additions to Station #2 will be accomplished. These upgrades include: Increased living and sleeping quarters, additional apparatus bay to store equipment and remodeling to the inside to help comply with the latest industry standards. This is a competitive grant, however not a matching grant. If granted the funds will be directed to the City for Fire Department for construction.

9-5. Finance

Action to adopt a resolution to levy the Carson City Fiscal Year 2009-10 Ad Valorem Tax Rate subject to certification by the Nevada Tax Commission. (Nick Providenti)

Staff Summary: By law, the Board of Supervisors sets the Carson City Tax Rate once per year after the Nevada Tax Commission certifies the tax rates. This resolution sets the tax rate as approved in the Board of Supervisors and Redevelopment Authority budget hearings as well as setting the local rate for other governing bodies.

11. First Judicial District Court

Action to adopt on second reading, Bill No. 111, an ordinance amending Title 2 Administration and Personnel by adding Chapter 2.33 Fees on Court Actions to Support Programs for Court Security, adding Section 2.33.010 Fees in District Court, which requires a twenty dollar fee to be paid when commencing an action in district court or answering an action that has been commenced, and adding Section 2.33.020 Collection - Payment to Treasurer, which delineates how the fee is collected and how it can be used and other matters properly related thereto. (Max Cortes)

Staff Summary: The passing of Assembly Bill No. 65, allows the District Courts to add $20 to filing fees collected by the District Courts. On or before the fifth day of each month, the clerk of the court shall account for and pay over to the Treasurer any such fees collected by him during the preceding month for credit to an account in the general fund. The General Fund account may only be used for programs for court security. It must not be used to supplant existing budgets for bailiffs or deputy marshals who are assigned to work in a courtroom; and if any balance remains, may be carried forward to the next fiscal year. Programs for court security includes, without limitation: Funding for additional positions for bailiffs, marshals, security guards or similar personnel; Supplementing existing funding used to pay bailiffs, marshals, security guards and similar personnel; Acquiring necessary capital good for court security; Providing security training and education to personnel; Conducting security audits; and Acquiring or using appropriate technology relating to court security.

Staff Summary: Carson City Animal Services (CCAS) provides numerous programs and services to the public. The proposed amendments within this title will clarify CCAS roles and responsibilities. In addition, the amendments will address public opinions and standards concerning animal laws of which have changed, and have been expressed, since the original writing of Title 7. The following are a few highlights of the proposed amendments: clarification of Carson City's leash law, roaming cats, and animal zoning. In addition to this, changes are proposed for ferret permits, increase in license fees, and better language for rabies vaccinations.

13. Purchasing and Contracts

Action to determine that A & K Earth Movers, Inc. is the lowest responsive and responsible bidder pursuant to NRS Chapter 338 and to award Contract No. 0809-237 Carson City Freeway Phase 2B Utility Relocations South Edmonds Drive Sewer Project to A & K Earth Movers, Inc., for a bid amount of $620,381.00 plus a contingency amount not to exceed $100,000.00 to be funded from the Edmonds Utility Relocations and Sewer NDOT Non Reimbursable Funds as provided in FY 2009/2010. (Sandy Scott)

Staff Summary: Sealed bids were received for all labor, materials, tools and equipment necessary for the Carson City Freeway Phase 2B Utility Relocations Edmonds Drive Sewer Project. The project consists of, but is not limited to, construction of 3,256 lineal feet of new 8-inch sewer main along South Edmonds Drive including construction of 12 sanitary sewer laterals with cleanouts; roadway restoration by pulverizing the existing asphalt surface and repaving; roadway widening at the intersection of South Edmonds Drive and Koontz Lane to accommodate future left turn lanes; and other related work including storm drainage, abandonment of existing pipes, striping and signage.

14. Parks and Recreation

A) Action to authorize the Open Space Manager to execute a Question-1 State Conservation Program funding agreement and deed restriction, and other matters properly related thereto, in order to obtain approximately $2,184,070 in reimbursement for the fee title acquisition of the Hutchison, Desormier, and Anderson open space properties. (Juan Guzman)

Staff Summary: On February 19, 2009, the Board of Supervisors conceptually approved a deed restriction and funding agreement template previously negotiated with the help of Supervisors Williamson and Aldean. These documents reflect the language negotiated and will result in reimbursement of funds to be deposited in the Question-18 Open Space account. These three properties were purchased solely with Question 18 Open Space funds.

B) Action to adopt a resolution adopting and approving an Interlocal Agreement between Carson City School District, a political subdivision of the State of Nevada, and Carson City, Nevada, a consolidated municipality and political subdivision of the State of Nevada, for Carson City Parks & Recreation Department to perform all turf maintenance operations during the months of March through October annually on approximately 18 acres of Carson City School District playing fields and passive grounds where natural grass grows. (Roger Moellendorf)

Staff Summary: Carson City Parks & Recreation Department does not currently perform any turf maintenance for the Carson City School District. The Carson City School District has asked Carson City Parks & Recreation Department to begin providing turf maintenance on approximately 18 acres of School District playing fields and passive grounds. Adoption of this agreement will allow Carson City Parks & Recreation Department to perform all turf maintenance operations during the months of March through October annually on approximately 18 acres of Carson City School District playing fields and passive grounds where natural grass grows.

15. Public Works - Planning

A) Action to introduce an ordinance to approve a development agreement between Carson City and Roventini, LLC, regarding the development of a Planned Unit Development subdivision known as Clearview Ridge, located west of Cochise Street between West Roventini Way and West Overland Street, east of Voltaire Street, APN's 9-263-06, -07, -08 and -09, to extend the approval of the tentative map. (Lee Plemel)

Summary: The primary purpose of the development agreement is to extend the initial approval of the tentative subdivision map, which would expire on September 21, 2009. The agreement was previously approved by the Board of Supervisors on May 21, 2009, but the agreement must be adopted by ordinance in order to take effect.

B) Action to adopt Bill No. 113, on second reading, an ordinance amending the Carson City Municipal Code Title 18 Zoning, Chapter 18.03, Definitions, Section 18.03.010, Words and Terms Defined, to modify the definition of "Wind Energy/Conversion Facility" to "Wind Energy Conversion System, Private Use" and to add a definition for "Wind Machine"; and amending the Carson City Municipal Code Title 18 Zoning, Chapter 18.05, General Provisions, by adding Section 18.05.080, Private Use Wind Energy Conversion Systems to set forth specific standards and criteria for these systems, and other matters properly related thereto. Summary: The proposed ordinance would create standards for the placement and use of small wind turbines for personal use in all areas of Carson City, including residential and commercial areas. Small wind turbines are only for personal use to offset the cost of electricity to a home or business. There are currently no specific standards for such devices in the Carson City Municipal Code.

C) Action to accept the recommendations of the Silver Saddle Ranch and Carson River Charrette Summary, Creating a Community Vision, regarding the planning vision for public recreation and open space opportunities on the Silver Saddle Ranch, Prison Hill area and along the Carson River. Summary: The Friends of Silver Saddle Ranch organization, in cooperation with the Carson City Parks and Recreation Department, BLM and the National Park Service, conducted several public workshops in the spring of 2008 to develop a recreation and open space plan for the public lands in the subject area. The vision document is intended to guide future decisions by Carson City regarding the use of these lands.
