The State of Nevada and Carson City are currently in a declared State of Emergency in response to the global pandemic caused by the coronavirus (COVID-19) infectious disease outbreak. In accordance with the Governor’s Declaration of Emergency Directive 006, which has suspended the provisions of NRS 241.020 requiring the designation of a physical location for meetings of public bodies where members of the public are permitted to attend and participate, public meetings of Carson City will NOT have a physical location open to the public until such time this Directive is removed.

Consent Agenda
All matters listed under the consent agenda are considered routine and may be acted upon by the Board of Supervisors with one action and without an extensive hearing. Any member of the Board may request that an item be taken from the consent agenda, discussed and acted upon separately during this meeting. The Mayor, or the Mayor Pro-Tem, retains discretion in deciding whether or not an item will be pulled off the consent agenda.
8. City Manager
8.A For Possible Action: Discussion and possible action regarding the reappointment of two members to the 9-1-1 Surcharge Advisory Committee, each for a term ending in December, 2022. (Nancy Paulson, npaulson@carson.org)
Staff Summary: As required by Nevada Revised Statutes ("NRS") 244A.7645, the Board of Supervisors previously adopted Carson City Municipal Code ("CCMC") 4.05.030 to create a six-member advisory committee called the “9-1-1 Surcharge Advisory Committee” for the purpose of developing a plan to enhance or improve the telephone system for reporting emergencies in Carson City and for overseeing any money allocated to that purpose. Denise Stewart and Daniel Mckeehan occupy at-large positions that will expire in December, 2020 and are therefore seeking reappointment.
8.B For Possible Action: Discussion and possible action regarding the appointment of three members to the Audit Committee, two for a full term ending in December, 2022 and one to fill an unexpired term ending in December, 2021. (Nancy Paulson, npaulson@carson.org)
Staff Summary: Carson City Municipal Code ("CCMC") 2.14.030 provides for a five-member Audit Committee, comprised of one member from the Board of Supervisors and four members from the public as citizens-at-large. There are two vacancies due to the expiration of terms and one vacancy due to a member resignation as the result of a change in eligibility. All three vacancies are citizen-at-large positions. Ernie Mayhorn and Stephen Ferguson are seeking reappointment. A new application was submitted by James Wells to fill the remainder of the unexpired term created by the member resignation.
9. Finance
9.A For Possible Action: Discussion and possible action regarding the report on the condition of each fund in the treasury and the statements of receipts and expenditures through November 20, 2020, per NRS 251.030 and NRS 354.290. (Sheri Russell, srussell@carson.org)
Staff Summary: NRS 251.030 requires the Chief Financial Officer (for the purpose of the statute acting as the County Auditor) to report to the Board of Supervisors, at each regular meeting thereof, the condition of each fund in the treasury. NRS 354.290 requires the County Auditor to report to the Board of Supervisors a statement of revenues and expenditures based on the accounts and funds as were used in the budget. A more detailed accounting is available on the City’s website – www.carson.org.
10. Public Works
10.A For Possible Action: Discussion and possible action regarding a proposed grant of non-exclusive easement from the State of Nevada, Division of State Lands to Carson City for $250 per year for five years, for a total of $1,250 which is then subject to a possible fee adjustment unless terminated by either party, for production well #50 and a waterline connection from the well to the city water system located at the Northern Nevada Correctional Center (NNCC), APN 010-281-46. Staff Summary: The subject easement is for an existing production well and waterline connection located at the NNCC on Bigelow Drive. The City entered into an agreement on August 11, 2009 with the State to provide water service to NNCC with the provision that the State make available sufficient water rights to meet the needs of NNCC and grant the necessary authorizations and easements to the City for the purpose of drilling, constructing and operating production well #50. The well was constructed by the City in accordance with Carson City Project No. 4.0817 dated March 3, 2009 and the non-exclusive easement is being granted by the State in accordance with the terms of the Agreement.
11. Purchasing and Contracts
11.A For Possible Action: Discussion and possible action regarding Amendment No. 1 to Contract No. 20300032, On-call Geographic Information System Services, with Atkins, to increase the contract amount by $50,000 for a new total contract amount of $99,999 through June 30, 2021 to be funded from the General Fund / GIS-Professional Services Account. Staff Summary: Atkins provides on-call support to Carson City GIS for the deployment of Esri’s Enterprise GIS platform, deployment of web applications, mobile data collection tools, dashboard development, database management, and system administration. In addition, Atkins supported the successful completion of the enterprise asset management needs assessment and software evaluation in the spring of 2020, providing best practice recommendations, including a framework toward developing a Carson City strategic asset management plan (SAMP). Staff recommends continuing the engagement of Atkins. With the proposed amendment, the total contract amount exceeds $50,000 and therefore requires Board of Supervisors' approval.

13.A For Possible Action: Discussion and possible action regarding a final appropriation for the Community Support Services 5-Year Grant ("CSSG") funding for Fiscal Year ("FY") 2022 to FY 2026. (Mirjana Gavric, MGavric@carson.org) Additional Backup
Staff Summary: The CSSG total funding for this program for FY 2022 to FY 2026 is $572,500. Staff recommends $114,500 be awarded each year for the general non-competitive program. The start and end dates for the 5-year non-competitive program are July 1, 2021 to June 30, 2026. The decision to allocate CSSG funding to Carson City non-profit organizations is in accordance with the recommendation of the Application Review Work Group (ARWG). The ARWG is a community-based group that reviewed and scored the applications on November 17, 2020, for recommendation to the Board of Supervisors. The ARWG took into consideration the application score, the amount requested, the ability for the agency to obtain other funding and the critical need requirement.
14. Purchasing and Contracts
14.A For Possible Action: Discussion and possible action regarding a determination that LP Insurance Services, Inc., is the lowest responsive and responsible bidder pursuant to NRS Chapter 332 and whether to award Contract No. 20300070 for Insurance Brokerage and Consulting Services to LP Insurance Services, Inc. for a not to exceed annual amount of $35,000 through December 31, 2025 for a total contract amount of $175,000 to be funded from the Group Medical Insurance Professional Services Account. Staff Summary: Carson City contracted with LP Insurance Services for insurance brokerage and consulting services, effective January 1, 2017 to December 31, 2020. The Human Resources Department worked with the Purchasing & Contracts Department to issue a Request for Proposal on September 1, 2020. Six proposals were received and the Carson City Review and Selection Committee selected LP Insurance Services, Inc. to recommend to the Board of Supervisors for award.
14.B For Possible Action: Discussion and possible action regarding the purchase of 32 vehicles for several departments throughout the City, utilizing the State of Nevada’s competitive bid list and cooperative purchasing agreements through Sourcewell and HGACBuy for a total not to exceed amount of $2,594,450.39. (Carol Akers, CAkers@carson.org and Rich Hardcastle, RHardcastle@carson.org)
Staff Summary: Multiple city departments are looking to replace vehicles due to the age and/or condition of the vehicles. The vehicles being replaced are at the end of their useful lives and it is not cost-effective to continue to maintain these vehicles. Staff seeks approval for a total of 32 vehicles to be replaced. These requested purchases were planned for and are funded as part of the approved fiscal year (“FY”) 2021 Capital Improvement Vehicle Replacement Program or funded by grants/donations.

15.A For Possible Action: Discussion and possible action regarding a business impact statement concerning a proposed ordinance amending Title 12 and Title 18 Appendix of the Carson City Municipal Code (“CCMC”), and concerning a proposed "Carson City Drainage Manual" (“Drainage Manual”), which together would implement low impact development (“LID”) standards in Carson City. (Darren Schulz, Dschulz@carson.org; Dan Stucky, Dstucky@carson.org and Robb Fellows, Rfellows@carson.org)
Staff Summary: NRS 237.080 requires that Carson City prepare a business impact statement when a new ordinance or a new rule that imposes a fee that is paid by businesses is proposed. This business impact statement concerns a proposed ordinance and the proposed adoption of the Drainage Manual which, if adopted, would implement LID standards in Carson City. The proposed business impact statement finds that the proposed ordinance and Rate Schedule will not impose a direct and significant economic burden upon a business or directly restrict the formation, operation or expansion of a business.
15.B For Possible Action: Discussion and possible action to introduce, on first reading, a proposed ordinance amending Title 12 and Title 18 Appendix of the Carson City Municipal Code ("CCMC") to establish various provisions implementing low impact development standards, establishing general requirements for compliance with low impact impact development standards, authorizing exemptions to compliance with low impact development standards under certain circumstances, adopting and incorporating by reference the Carson City Drainage Manual and repealing various provisions of Division 14 of Title 18 Appendix. Staff Summary: This will be the first reading of a proposed ordinance which, if enacted, will add a new chapter to Title 12 of the CCMC to implement low impact development ("LID") practices and standards in Carson City. The existing provisions of Division 14 of Title 18 Appendix of the CCMC would mostly be repealed, but a new section would be codified to adopt and incorporate by reference the "Carson City Drainage Manual" which contains the LID standards.
15.C For Possible Action: Discussion and possible action regarding a proposed Utility Rate Schedule to become effective on January 1, 2021, for Carson City water, wastewater and storm water utility rates and fees, to increase the existing water rates by 3% and the wastewater rates by 3.5% and to raise the storm water rates based on the square footage of structures on single-family properties and the impervious area for all other properties, as provided in the Rate Schedule. Staff Summary: This item, if approved and adopted, will establish the Utility Rate Schedule which increases the water service charge by 3.0% on January 1, 2021, July 1, 2021, July 1, 2022, July 1, 2023, and July 1, 2024; increases the wastewater service charge by 3.5% on January 1, 2021, July 1, 2021, July 1, 2022, July 1, 2023, and July 1, 2024; and restructures storm water rates and increases the storm water service charges on January 1, 2021, January 1, 2022, January 1, 2023, and January 1, 2024.
15.D For Possible Action: Discussion and possible action regarding the adoption, on second reading, of Bill No. 115, a proposed ordinance amending Title 12 of the Carson City Municipal Code ("CCMC") to revise various provisions relating to water, wastewater and storm water utility rates, and to revise provisions relating to the Utility Ratepayer Assistance Program. Staff Summary: This will be the second reading of a proposed ordinance which, if adopted, will increase the water service charge by 3.0% on January 1, 2021, July 1, 2021, July 1, 2022, July 1, 2023, and July 1, 2024; increase the wastewater service charge by 3.5% on January 1, 2021, July 1, 2021, July 1, 2022, July 1, 2023, and July 1, 2024; restructure storm water rates and increase the storm water service charges on January 1, 2021, January 1, 2022, January 1, 2023, and January 1, 2024; remove water and wastewater connection fees and water, wastewater and storm water user charges from CCMC Title 12 and create a "Rate Schedule"; establish provisions authorizing up to $10,000 annually in funding from each of the utility funds to the Utility Ratepayer Assistance Program; and make other conforming changes.
15.E For Discussion and Possible Action: Discussion and possible action regarding a proposed Carson City Drainage Manual concerning the development and implementation of best management practices, low impact development (“LID”) practices and control measures needed to protect water quality and reduce the discharge of pollutants from the City's storm drainage facilities. (Darren Schulz, Dschulz@carson.org; Dan Stucky, Dstucky@carson.org and Robb Fellows, Rfellows@carson.org)
Staff Summary: LID is a storm water management approach to land development and redevelopment that works to manage storm water close to its source. LID practices can be effective in reducing runoff quantity, enhancing groundwater recharge, preserving flood plain storage and removing pollutants by filtration and biological processes before entering the City’s storm drainage system. Through an accompanying ordinance and this Manual, the storm water standards would be removed from Division 14 of the Title 18 Appendix (Development Standards) of the Carson City Municipal Code ("CCMC") and placed in a standalone manual.
15.F For Possible Action: Discussion and possible action regarding a proposed interim interlocal contract ("Agreement") with the State of Nevada for the purchase of water by Carson City from the Marlette Lake Water System in fiscal year (“FY”) 2022 and 2023, for a total not to exceed amount of $2,700,000. (Darren Schulz, dschulz@carson.org and Eddy Quaglieri, equaglieri@carson.org)
Staff Summary: The City's negotiations with the State are still ongoing for a long-term agreement concerning the Marlette Lake Water System. At this time, the State has engaged in a rate study, the City has engaged in a Marlette Lake Water System present and future demand study, and the City and State are awaiting the outcomes of both studies. However, in the interim, City and State staff propose an interim contract for FY 2022 and 2023 for the City to purchase water from the Marlette Lake Water System. Through the Agreement, the City agrees to pay for the ongoing bond service, approximately $50,000 per month, a monthly charge for operation and maintenance fees of $12,099 per month, and to pay for raw water at the rate of $0.75 per thousand gallons. The City's payments for the operation and maintenance fee and for the raw water, combined, are capped at $550,000 in both FY 2022 and 2023. Thus, the City's yearly payments are subject to a cap of approximately $1.15 million per year (approximately $600,000 in bond payments and $550,000 for operation and maintenance fees and for raw water). The City also pledges to make reasonable, good-faith efforts to purchase additional raw water if the water, and the City's funding, is available.
16. Board of Supervisors
16.A For Possible Action: Discussion and possible action regarding directives and recommendations concerning Carson City departmental and staff functions in Carson City as a consolidated municipality in relation to the exercise of emergency powers pursuant to NRS Chapters 244 and 414 and CCMC Chapter 6.02 for the purpose of ensuring the health, safety and welfare in Carson City in response to the global coronavirus (COVID-19) pandemic. Staff Summary: As the status of the global coronavirus is constantly in a state of unpredictability and a rapidly changing landscape with regard to the rate of infection, exposure to infection and the issuance of international, federal and state guidelines and recommendations to mitigate exposure to and the transmission of infectious disease, various staff will present an update on Carson City’s role in protecting the health, safety and welfare of its residents. In addition, this item is for the Board of Supervisors to issue, if it elects to do so, certain directives to City staff and departments concerning City-related functions, as well as any recommendations to the public or directives pursuant to the City’s emergency powers under a state of emergency in accordance with legal authority expressly granted by state and local law.

18. Community Development - Planning
18.A For Discussion Only: Discussion and presentation regarding possible amendments to Title 18 of the Carson City Municipal Code ("CCMC"), which establishes local ordinance provisions relating to zoning. (Lee Plemel, lplemel@carson.org)
Staff Summary: The Planning Commission is in the process of conducting workshops to take public comment regarding possible updates to Title 18 of CCMC, which establishes local ordinance provisions relating to zoning. This item is to allow an opportunity for the Board of Supervisors to provide comments regarding proposed amendments to CCMC Chapters 18.05 (General Provisions) and the Development Standards Division 1 (Land Use and Site Design). Final action regarding these chapters are not proposed to be taken by the Board of Supervisors until additional recommendations are considered by the Planning Commission to bring back to the Board at future meetings and after the District Attorney's Office has reviewed and finalized ordinance language for legality, style and convention. Other chapters of Title 18 will be reviewed separately at future meetings.

**PUBLIC COMMENT LIMITATIONS - The Mayor and Supervisors meet at various times as different public bodies: the Carson City Board of Supervisors, the Carson City Liquor and Entertainment Board, the Carson City Redevelopment Authority, and the Carson City Board of Health. Each, as called to order, will provide at least two public comment periods in compliance with the minimum requirements of the Open Meeting Law prior to adjournment. Although it has been the ordinary practice of these public bodies to provide an opportunity for additional public comment during each specific item designated for possible action on the agenda, public comment will be temporarily limited to the beginning of the agenda before any action is taken and again at the end before adjournment. This policy will remain effective during the period of time the State of Nevada is under a State of Emergency as declared by the Governor due to the COVID-19 pandemic, and is intended to achieve the efficient conduct of meetings while facilitating public participation via telephonic means. No action may be taken on a matter raised under public comment unless the item has been specifically included on the agenda as an item upon which action may be taken. The Mayor, Mayor Pro-Tem and Chair, also retain discretion to only provide for the Open Meeting Law’s minimum public comment and not call for or allow additional individual-item public comment at the time of the body’s consideration of the item when: 1) it is deemed necessary by the mayor/chair to the orderly conduct of the meeting; 2) it involves an off-site non-action facility tour agenda item; or 3) it involves any person’s or entity’s due process appeal or hearing rights provided by statute or the Carson City Municipal Code.
