The State of Nevada and Carson City are currently in a declared State of Emergency in response to the global pandemic caused by the coronavirus (COVID-19) infectious disease outbreak. In accordance with the Governor’s Declaration of Emergency Directive 006, which has suspended the provisions of NRS 241.020 requiring the designation of a physical location for meetings of public bodies where members of the public are permitted to attend and participate, public meetings of Carson City will NOT have a physical location open to the public until such time this Directive is removed.

Consent Agenda
All matters listed under the consent agenda are considered routine and may be acted upon by the Board of Supervisors with one action and without an extensive hearing. Any member of the Board may request that an item be taken from the consent agenda, discussed and acted upon separately during this meeting. The Mayor, or the Mayor Pro-Tem, retains discretion in deciding whether or not an item will be pulled off the consent agenda.
7. City Manager
7.A For Possible Action: Discussion and possible action on ratifying the approval of bills and other requests for payments by the City Manager for the period of January 9, 2021 through February 5, 2021. (Nancy Paulson, npaulson@carson.org)
Staff Summary: Pursuant to CCMC 2.29, the Controller will present all bills or other requests for payment by the City to the City Manager for approval. Upon approval, the register book of bills and other requests for payment and warrants are presented at least once a month to the Board of Supervisors, who shall by motion entered into its minutes, ratify the action taken.
8. Clerk-Recorder
8.A For Possible Action: Discussion and possible action regarding the Annual Technology Fund Report required to be submitted pursuant to NRS 247.306, containing the estimated proceeds collected by the Carson City Clerk-Recorder in Fiscal Year ("FY") 2021 and a proposal for the expenditures of those proceeds. (Aubrey Rowlatt, arowlatt@carson.org)
Staff Summary: This report shows the estimated proceeds and expenditures for FY 2021. NRS 247.306 requires the Carson City Clerk-Recorder to submit to the Board of Supervisors an annual report which contains: (1) an estimate of the proceeds that the county recorder will collect from the additional fee that is authorized to be charged for recording certain writings pursuant to subsection 2 of NRS 247.305 in the following FY; and (2) a proposal for expenditures of the proceeds from the additional fee imposed pursuant to subsection 2 of NRS 247.305 for the costs related to the technology required for the office of the Clerk-Recorder for the following FY.

9.A For Possible Action: Discussion and possible action regarding a request for a historical tax deferment on property located within the Historic District and zoned Residential Office, located at 408 West Robinson, APN 003-236-01. (Hope Sullivan, hsullivan@carson.org)
Staff Summary: The subject property is eligible for the Open Space Use Assessment as a result of its conformance to specific standards and its historical status in Carson City.
10. Finance
10.A For Possible Action: Discussion and possible action regarding the report on the condition of each fund in the treasury and the statements of receipts and expenditures through February 5, 2021, per NRS 251.030 and NRS 354.290. (Sheri Russell, srussell@carson.org)
Staff Summary: NRS 251.030 requires the Chief Financial Officer (for the purpose of the statute acting as the County Auditor) to report to the Board of Supervisors, at each regular meeting thereof, the condition of each fund in the treasury. NRS 354.290 requires the County Auditor to report to the Board of Supervisors a statement of revenues and expenditures based on the accounts and funds as were used in the budget. A more detailed accounting is available on the City’s website – www.carson.org.
11. Purchasing and Contracts
11.A For Possible Action: Discussion and possible action regarding Amendment No. 3 to Contract No. 1718-127 for Federal Lobbying Services with Porter Group, LLC, to extend the contract term for an additional year through February 20, 2022 and for a not to exceed additional amount of $49,800. (Carol Akers, cakers@carson.org and Nancy Paulson, npaulson@carson.org)
Staff Summary: The original contract term was effective February 20, 2018 to February 20, 2019 with two one-year options. The contract was subsequently extended by Amendments No. 1 & 2 through February 20, 2021. The Porter Group has submitted a proposal to the City to extend the contract term for an additional year with all other terms of the contract remaining the same.
12. Sheriff
12.A For Possible Action: Discussion and possible action regarding a proposed interlocal agreement between Carson City and Douglas County, to pass $46,000 in grant funds from the Department of Justice, 2020 Edward Byrne Memorial Justice Assistance Grant Program, to Douglas County for the TriNet Narcotics Task Force. (Sheriff Furlong, kfurlong@carson.org)
Staff Summary: The Board of Supervisors accepted this grant on January 21, 2021. The grant provides funds for the TriNet Narcotics Task Force personnel in both Carson City and Douglas County. This interlocal agreement is the mechanism through which to pass the grant funding on to Douglas County.
13. Treasurer
13.A For Possible Action: Discussion and possible action regarding the Treasurer’s monthly statement of all money on deposit, outstanding checks and cash on hand for January 2021, submitted per Nevada Revised Statute ("NRS") 354.280. (Gayle Robertson, grobertson@carson.org)
Staff Summary: NRS 354.280 requires the Treasurer to keep a record of the source and amount of all receipts, apportionments to, payments from and balances in all funds and to submit to the Board of Supervisors each month a statement containing that information for the previous month. The Treasurer must report the balance in each county, state and special fund, together with a statement of all money on deposit, outstanding checks against that money and cash on hand.

15.A For Possible Action: Discussion and possible action regarding the Historic Resources Commission Annual Report for 2020. (Hope Sullivan, hsullivan@carson.org)
Staff Summary: The Historic Resources Commission ("HRC") bylaws require the HRC to submit an annual report to the Board of Supervisors, including information about cases reviewed by the HRC, administrative reviews and information regarding other historic preservation activities.
16. Sheriff
16.A For Possible Action: Discussion and possible action regarding the proposed acceptance of a grant from the Nevada Department of Conservation and Natural Resources, Off-Highway Vehicles Program ("State"), to fund development of an off-highway vehicle program by the Carson City Sheriff's Office ("CCSO") for the period of January 1, 2021 through December 31, 2021 in the amount of $61,453, and whether to approve a project funding agreement between the State and CCSO memorializing the issuance and acceptance of the grant award. (Sheriff Furlong, kfurlong@carson.org)
Staff Summary: If approved, approval of this grant award will help support CCSO's current Off-Highway Vehicle program by funding equipment and overtime payments that are necessary for enforcement and education efforts relating to the use of off-highway areas located in Carson City. The grant is in the amount of $61,453 and requires a local match in the amount of $11,614.
17. City Manager
17.A For Possible Action: Discussion and possible action regarding the appointment of six members to the Carson City Cultural Commission, three members for terms that will expire in January 2022, two members for terms that will expire in January 2023, and one member for a term that will expire in January 2024. Staff Summary: Chapter 2.41 of the Carson City Municipal Code ("CCMC") provides for the creation and organization of a seven-member Cultural Commission. CCMC requires that the terms of the seven members be staggered. On January 7, 2021, the Board of Supervisors appointed Supervisor Stan Jones for a term that will expire in January 2024. There are six other vacancies due to expirations of terms. Reappointment requests have been submitted by Barbara D'anneo, Guadalupe Ramirez, Christopher Leyva, Karen Abowd and Elinor Bugli. New applications have been submitted by Aprilina Faave, Amy Clemens and Sierra Scott.
17.B For Discussion Only: Discussion and presentation regarding the transient lodging tax, including continuation of the 1% transient lodging tax ("tax") dedicated to the Arts and Culture Program currently administered by the Carson City Culture and Tourism Authority ("CTA"). Staff Summary: On May 5, 2016, the Carson City Board of Supervisors adopted Ordinance No. 2016-7 imposing a 1% transient lodging tax to be used primarily for the implementation of the Carson City Arts & Cultural Master Plan and development of a Cultural Tourism Campaign. The tax is set to expire by limitation on June 1, 2021.
18. Purchasing and Contracts
18.A For Possible Action: Discussion and possible action regarding purchase authority for roofing materials utilizing joinder Contract No. PW1925, from Racine County, Wisconsin, through Omnia Partners, with Garland/DBS, Inc., for a total not to exceed amount of $165,947.57, and a determination that CTR Roofing Ltd. is the lowest responsive and responsible bidder pursuant to NRS Chapter 338 and whether to award Contract No. 20300255, Library Roofing Project, to CTR Roofing Ltd. for a total not to exceed amount of $137,500. Staff Summary: This is for the purchase and installation of roofing materials for the Carson City Library roof. NRS 338.1423 requires the City to pay sales tax on materials purchased for installation by a licensed contractor. The licensed contractor will apply the product under Contract No. 20300255 for a base bid amount of $125,000, plus a 10% contingency amount of $12,500. The engineer's estimate for the labor was $230,000. The total cost of this project for materials and labor will be $303,447.57.
18.B For Possible Action: Discussion and possible action regarding the purchase of four vehicles for the Carson City Fire Department (“CCFD”), utilizing the State of Nevada’s competitive bid list and a cooperative purchasing agreement through HGACBuy, for a total not to exceed amount of $391,319.29. (Carol Akers, cakers@carson.org and Rich Hardcastle, rhardcastle@carson.org)
Staff Summary: CCFD is requesting the replacement of vehicles due to the age or condition of the vehicles. The vehicles requested to be replaced are at the end of their useful lives and it is not cost-effective to continue to maintain these vehicles. These requested purchases were planned for and are funded as part of the approved Fiscal Year (“FY”) 2021 Capital Improvement Vehicle Replacement Program or funded by grants.
19. Finance
19.A For Possible Action: Discussion and possible action regarding staff-recommended assumptions to be used in preparation of the Carson City Budget for Fiscal Year ("FY") 2022 (July 1, 2021 through June 30, 2022). (Sheri Russell, srussell@carson.org)
Staff Summary: Staff will present the recommended property tax rate and assumptions for preparation of the Carson City FY 2022 Budget. The City's governing body, the Board of Supervisors, is required to approve a property tax rate to be levied for FY 2022. The Department of Taxation requires all local governments to inform them of the rate they intend to use by February 22, 2021.
20. Public Works
20.A For Possible Action: Discussion and possible action regarding a business impact statement concerning a proposed ordinance amending Title 12 and Title 18 Appendix of the Carson City Municipal Code ("CCMC"), and concerning a proposed "Carson City Drainage Manual" ("Drainage Manual"), which together would implement low impact development ("LID") standards in Carson City. (Darren Schulz, dschulz@carson.org; Dan Stucky, dstucky@carson.org and Robb Fellows, rfellows@carson.org)
Staff Summary: NRS 237.080 requires that Carson City prepare a business impact statement when a new ordinance or a new rule that imposes a fee that is paid by businesses is proposed. This business impact statement concerns a proposed ordinance and the proposed adoption of the Drainage Manual which, if adopted, would implement LID development standards in Carson City. The proposed business impact statement finds that the proposed ordinance and Drainage Manual will not impose a direct and significant economic burden upon a business or directly restrict the formation, operation or expansion of a business.
20.B For Possible Action: Discussion and possible action regarding a proposed Carson City Drainage Manual concerning the development and implementation of best management practices, low impact development ("LID") practices and control measures needed to protect water quality and reduce the discharge of pollutants from the City's storm drainage facilities. (Darren Schulz, dschulz@carson.org; Dan Stucky, dstucky@carson.org and Robb Fellows, rfellows@carson.org)
Staff Summary: LID is a storm water management approach to land development and redevelopment that works to manage storm water close to its source. LID practices can be effective in reducing runoff quantity, enhancing groundwater recharge, preserving flood plain storage and removing pollutants by filtration and biological processes before entering the City’s storm drainage system. Through an accompanying ordinance and this Manual, the storm water standards would be removed from Division 14 of Title 18 Appendix (Development Standards) of the Carson City Municipal Code ("CCMC") and placed in a standalone manual.
20.C For Possible Action: Discussion and possible action to introduce, on first reading, a proposed ordinance amending Title 12 and Title 18 Appendix of the Carson City Municipal Code ("CCMC") to establish various provisions implementing low impact development standards, establishing general requirements for compliance with low impact development standards, authorizing exemptions to compliance with low impact development standards under certain circumstances, adopting and incorporating by reference the Carson City Drainage Manual and repealing various provisions of Division 14 of Title 18 Appendix. Staff Summary: This will be the first reading of a proposed ordinance which, if enacted, will add a new chapter to Title 12 of the CCMC to implement low impact development ("LID") practices and standards in Carson City. The existing provisions of Division 14 of Title 18 Appendix of the CCMC would mostly be repealed, but a new section would be codified to adopt and incorporate by reference the "Carson City Drainage Manual" which contains the LID development standards.

25.A For Possible Action: Discussion and possible action regarding the Fiscal Year ("FY") 2021 and 2022 Redevelopment discretionary funds tentative budget allocations and estimation of allocations for the following four years for the purposes of Redevelopment Revolving Fund budget planning to implement redevelopment objectives. (Lee Plemel, lplemel@carson.org)
Staff Summary: The Redevelopment Authority Citizens Committee ("RACC") annually makes recommendations to the Redevelopment Authority regarding the allocation of undesignated Redevelopment funds and certain discretionary program funds. The Redevelopment Authority may consider funding for certain projects and programs for the current fiscal year (FY 2021) and following years. The tentative budget allocations will be used to include the projects and programs in the FY 2022 Redevelopment budget as well as tentatively reserving funds for specific projects or programs in future years. The Redevelopment Authority may accept the recommended budget allocations or modify the recommended allocations.
25.B For Possible Action: Discussion and possible action regarding a recommendation to the Board of Supervisors for the expenditure of $121,573 from the Fiscal Year ("FY") 2021 Redevelopment Revolving Fund for downtown holiday decorations in the amount of $95,000, bike racks for businesses in the amount of $5,000, V&T arch conceptual plans in the amount of $20,000 and historic V&T bike and pedestrian trail markers in the amount of $1,573. 29.B For Possible Action: Discussion and possible action to introduce, on first reading, an ordinance relating to zoning and establishing various provisions to change the zoning from Single Family 1 Acre (SF1A) to Single Family 6,000 (SF6) on property located at the northeast corner of Silver Sage Drive and Clearview Drive, APN 009-124-03. Staff Summary: The applicant is seeking to rezone a vacant 5.27-acre parcel from SF1A to SF6 consistent with the Master Plan designation of Medium Density Residential. The Board of Supervisors ("Board") is authorized to approve the zoning map amendment. The Board considered the Zoning Map Amendment on June 18, 2020; however, the Board declined to take action and continued the matter to allow the applicant to either bring forward an alternative zoning request or a lot layout that would address the concerns of the neighborhood. The applicant has since applied for a Tentative Subdivision Map, SUB-2020-0016, pursuant to Carson City Municipal Code ("CCMC") 17.10- Common Open Space Development, proposing the creation of 28 single family residential lots with 1.13 acres of common open space.
29.C For Possible Action: Discussion and possible action regarding a request for a Tentative Subdivision Map known as Borda Crossing, proposing to create 28 single family residential lots on a 5.27 acre parcel zoned Single Family 1 Acre (SF1A), located at the northeast corner of Silver Sage Drive and Clearview Drive, APN 009-124-03. Staff Summary: The applicant is proposing to create 28 residential lots, with a minimum lot size of 5,009 square feet. Vehicular access is proposed from Silver Sage Drive and Center Drive. The plans include large, landscaped buffer areas to the north and south. The Tentative Subdivision Map is dependent upon the approval of a Zoning Map Amendment (ZA-2020-0005) from Single Family 1 Acre to Single Family 6,000. The Board of Supervisors has the authority to approve a Tentative Subdivision Map following recommendation from the Planning Commission.
30. Health and Human Services
30.A For Possible Action: Discussion and possible action regarding ratification of the submission of a grant application to the Nevada Department of Health and Human Services, Division of Public and Behavioral Health, requesting a total of $277,947 for a 2-year grant from The Fund for a Healthy Nevada. Staff Summary: The Carson City Department of Health and Human Services (“CCHHS”) submitted a grant application due to a short application window. Funds are for a 2-year grant period totaling $277,947 ($142,524 for year 1, and $135,423 for year 2). The grant is part of the Nevada Tobacco Control Program and does not require matching funds from Carson City.
30.B For Possible Action: Discussion and possible action regarding the appointment of a County Health Officer for Carson City and whether to approve Contract No. 20300270, County Health Officer, for a term beginning March 1, 2021 and terminating on December 31, 2022, for an amount not to exceed $2,500 per month for a total amount of $55,000 to be funded from the Health Administration Professional Services account in the General Fund. Staff Summary: Dr. Susan Pintar is currently serving as Carson City’s Health Officer and her contract expires on February 28, 2021. The vacancy was advertised on the City's website and with the local news organizations and the Nevada State Medical Association which sent notice to all of its members regarding the vacancy and posted the advertisement on its fact sheet. The City received one application for the vacancy from Dr. Colleen Lyons.
30.C For Possible Action: Discussion and possible action regarding a proposed resolution authorizing the City Manager, in consultation with the Mayor, to execute any future lease agreement for real property to be used by Carson City as COVID-19 vaccination sites for the duration of the state of emergency declared by the Nevada Governor as the result of the coronavirus pandemic, if the agreement does not exceed $50,000 and is paid by available grant funding. Staff Summary: The Carson City Department of Health and Human Services ("CCHHS") is working to find large buildings to lease or have donated to the City's use for large indoor vaccination events. NRS 244.275 requires a lease agreement for real property to be approved by the Board of Supervisors ("Board"). This item is not for a currently proposed lease agreement. Instead, if approved, this item would delegate authority to the City Manager, in consultation with the Mayor, to execute any lease agreement on behalf of the City for the specific purpose of establishing COVID-19 vaccination sites in lieu of bringing each agreement to the Board for approval so long as the agreement does not exceed $50,000 and is paid by available grant funding.

31.A For Possible Action: Discussion and possible action regarding directives and recommendations concerning Carson City departmental and staff functions in Carson City as a consolidated municipality in relation to the exercise of emergency powers pursuant to NRS Chapters 244 and 414 and CCMC Chapter 6.02 for the purpose of ensuring the health, safety and welfare in Carson City in response to the global coronavirus (COVID-19) pandemic. Staff Summary: As the status of the global coronavirus is constantly in a state of unpredictability and a rapidly changing landscape with regard to the rate of infection, exposure to infection and the issuance of international, federal and state guidelines and recommendations to mitigate exposure to and the transmission of infectious disease, various staff will present an update on Carson City’s role in protecting the health, safety and welfare of its residents. In addition, this item is for the Board of Supervisors to issue, if it elects to do so, certain directives to City staff and departments concerning City-related functions, as well as any recommendations to the public or directives pursuant to the City’s emergency powers under a state of emergency in accordance with legal authority expressly granted by state and local law.
31.B For Possible Action: Discussion and possible action regarding coordination of legislative activity on pending state legislation before the Nevada Legislature and whether to adopt an official policy position or direct staff and Carson City's retained lobbyist to advocate for or against any such legislation, including the submittal of proposed amendatory language. Staff Summary: The Nevada Legislature is currently in its 81st Regular Session. This item is for the Board of Supervisors to coordinate legislative efforts on pending state legislation that may have an impact on Carson City, including the adoption of official policy positions, if any, and direction to staff and the City's retained lobbyist to advocate for or against any such legislation. Due to unpredictable timing constraints inherent in the legislative process, the City will maintain a list of legislation that the City has identified in advance and which may be discussed and acted on by the Board during this agenda item. **PUBLIC COMMENT LIMITATIONS - The Mayor and Supervisors meet at various times as different public bodies: the Carson City Board of Supervisors, the Carson City Liquor and Entertainment Board, the Carson City Redevelopment Authority, and the Carson City Board of Health. Each, as called to order, will provide at least two public comment periods in compliance with the minimum requirements of the Open Meeting Law prior to adjournment. Although it has been the ordinary practice of these public bodies to provide an opportunity for additional public comment during each specific item designated for possible action on the agenda, public comment will be temporarily limited to the beginning of the agenda before any action is taken and again at the end before adjournment. This policy will remain effective during the period of time the State of Nevada is under a State of Emergency as declared by the Governor due to the COVID-19 pandemic, and is intended to achieve the efficient conduct of meetings while facilitating public participation via telephonic means. No action may be taken on a matter raised under public comment unless the item has been specifically included on the agenda as an item upon which action may be taken. The Mayor, Mayor Pro-Tem and Chair, also retain discretion to only provide for the Open Meeting Law’s minimum public comment and not call for or allow additional individual-item public comment at the time of the body’s consideration of the item when: 1) it is deemed necessary by the mayor/chair to the orderly conduct of the meeting; 2) it involves an off-site non-action facility tour agenda item; or 3) it involves any person’s or entity’s due process appeal or hearing rights provided by statute or the Carson City Municipal Code.
Agenda Management Notice - Items on the agenda may be taken out of order; the public body may combine two or more agenda items for consideration; and the public body may remove an item from the agenda or delay discussion relating to an item on the agenda at any time.
