Items scheduled at a specific time cannot be heard earlier than at the scheduled time per the Nevada Open Meeting Law Requirements. A dinner recess may be taken.  If a dinner recess is taken, any unfinished business will be heard after the meeting is resumed.

F.         Public Hearing Matters

F-1(A)  VAR-15-022  For Possible Action:  To consider a request for a Variance from Albert and Bonnie Replogle (property owner: Albert and Bonnie Replogle) to reduce the required lot size from one acre to 0.51 acre for 4227 Ponderosa Drive, and to reduce the required rear-yard setback from 30 feet to 0 feet for an existing 288 square foot shed and from 30 feet to 16 feet for an existing 42 square foot shed, and for 4151 Ponderosa Drive, to reduce the required rear-yard setback from 30 feet to 18 feet for an existing barn, to accommodate a lot line adjustment on property zoned Single Family One Acre (SF1A), APNs 009-148-14 and -16.  (Kathe Green)  LATE INFORMATION

Summary:  The applicant is proposing to reduce the required lot size, lot dimensions and setback requirements of two parcels in the Single Family 1 Acre zoning district in order to facilitate a proposed lot line adjustment between the two parcels to change the configuration of the parcels. One of the existing parcels that is 0.71 acre in size will become larger at 1.34 acres and the other presently 1.13 acre in size will become smaller at .51 acre.

F-1(B)  ADM-15-037  For Possible Action:  To consider a request for an Administrative Permit from Albert Replogle (property owner: Albert Replogle) to allow detached accessory structures of 50-75% of the size of the primary structure on property zoned Single Family One Acre (SF1A), located at 4151 Ponderosa Dr., APN 008-148-16.  (Kathe Green)  LATE INFORMATION

Summary: The proposed lot line adjustment associated with this application and the associated Variance application (VAR-15-022) will result in this parcel getting an additional detached accessory structure, which results in the total area of the detached accessory structures on this parcel increasing to 73%. Approval of an Administrative Permit is required to have detached accessory structures that, in aggregate, are between 50% and 75% of the main structure size. No new accessory structures are being constructed.  The Department Director has referred this application to the Planning Commission to be reviewed concurrently with the Variance application.

F-2  GM-15-035   For Possible Action:  For Possible Action: To recommend to the Board of Supervisors a Resolution establishing the maximum number of residential building permit allocations under the Growth Management Ordinance for the years 2016 and 2017 and estimating the maximum number of residential building permits for the years 2018 and 2019; establishing the number of building permit allocations within the Development and General Property Owner categories; and establishing a maximum average daily water usage for commercial and industrial building permits as a threshold for Growth Management Commission review.  (Lee Plemel)

Summary:  The Planning Commission, acting as the Growth Management Commission, is required to make annual recommendations to the Board of Supervisors to establish the number of residential permits that will be available for the following calendar year.  This has historically been based upon a maximum growth rate of three percent.  The commercial and industrial daily water usage threshold has historically been 7,500 gallons per day annual average, above which Growth Management Commission approval is required. F-3(A)  VAR-15-042 part 1   part 2   part 3   part 4   part 5   For Possible Action:  To consider a request for a Variance from Divinni NV, LLC (property owner: MJ Meek Ltd Part et al and Enterprises Realty) to reduce the minimum lot size from 43,560 square feet (one acre) to approximately 39,204 square feet (0.9 acre), and to reduce the minimum lot frontage width on a cul-de-sac lot from 54 feet to 49 feet for a Tentative Subdivision Map, on property zoned Single Family One Acre (SF1A), located east of Hillview Drive between Clearview Drive and East Appion Way, APNs 010-194-07 and -08  (Lee Plemel)

Summary:  The Single Family One Acre zoning district allows the creation of parcels a minimum of one acre in size. The applicant is proposing to reduce the lot size of 10 of the 18 proposed lots to less than one acre with a minimum of 0.9 acre. Additionally, four of the cul-de-sac lots are proposed to have lot frontages of 48-50 feet rather than the minimum of 54 feet.

F-3(B)  TSM-15-036  part 1   part 2   part 3   part 4   part 5   To make a recommendation to the Board of Supervisors regarding a Tentative Subdivision Map application from Divinni NV, LLC (property owner: MJ Meek Ltd Part et al and Enterprises Realty) to create 18 single-family lots within two existing parcels totaling approximately 19.54 acres, on property zoned Single Family One Acre (SF1A), located east of Hillview Drive between Clearview Drive and East Appion Way, APNs 010-194-07 and -08.  (Lee Plemel)

Summary:  A Tentative Subdivision Map is required to subdivide a property into separate lots. The Single Family One Acre zoning district allows the creation of parcels a minimum of one acre in size.

F-4  SUP-15-038  part 1   part 2   part 3   part 4   part 5     For Possible Action:  To consider a request for a Special Use Permit from Carson City Center Development, LLC (property owners: Adams Divine, LLC and Adams Carson, LLC; NV Independant Insurance Agents; Carson City; State of Nevada Division of State Lands) to allow modification of certain Downtown Mixed Use Development Standards, CCMC 18.16, Division 6, pursuant to the alternative compliance provisions of CCMC 18.07.020, including provisions related to project height (building envelope standards), percentage of retail space around the parking structures, and sidewalk width for the development of an office, retail-commercial, and hotel development project known as the Capitol Mall project on property zoned Downtown Mixed-Use (DTMU), located at 220 E. Summary:  The proposed project includes a 150-room hotel, a 750-1,000 seat conference center, offices, mixed retail and commercial space, public plazas, and associated structured parking on a total of approximately 10.5 acres of property within the downtown area. Where a plan does not meet the development standards within the DTMU zoning district, an applicant may request by Special Use Permit that the Planning Commission approve an alternative approach to the standards that would provide a result that is equal to or superior to that which would be provided by the strict application of the standards. This provision is intended to provide for flexibility in design within the DTMU area.

Summary: The proposed development is estimated to use approximately 83,136 average gallons of water per day, in aggregate. The estimated average daily water usage by building, including landscaping irrigation, is as follows:  Building A, 1,314 gallons; Building B (Hotel), 36,256 gallons; Building C, 26,488 gallons; Building D, 3,095 gallons; and Building E, 18,983 gallons. Any business that exceeds 7,500 gallons of water per day requires review and approval pursuant to the Growth Management Ordinance, Carson City Municipal Code Section 18.12.

**  PUBLIC COMMENT:  The Commission will provide at least two public comment periods in compliance with the minimum requirements of the Open Meeting Law prior to adjournment.  In addition, it is Carson City’s aspirational goal to also provide for item-specific public comment as follows:  In order for members of the public to participate in the public body’s consideration of an agenda item, the public is strongly encouraged to comment on an agenda item when called for by the Chair during the item itself.  No action may be taken on a matter raised under public comment unless the item has been specifically included on the agenda as an item upon which action may be taken.  Comments may be limited to three minutes per person or topic at the discretion of the Chair in order to facilitate the meeting
